Terms of Service

1. Acceptance of Terms

By accessing or using Pitts ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including operators, fleet managers, and individual vehicle owners.

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. The date at the top of this page reflects the most recent revision.

2. Description of Service

Pitts provides AI-assisted vehicle diagnostic reports. The Service allows you to:

  • Submit vehicle symptoms and evidence (text, audio, images, OBD codes) through a conversational AI interface.
  • Receive an AI-generated diagnostic draft.
  • Optionally, purchase a human-mechanic review of the AI draft.
  • Request live video consultations with a mechanic (where available).
  • Track vehicle history and manage fleet cases.

The Service is for informational purposes only and does not replace a physical inspection by a qualified mechanic. See our AI Diagnostic Disclaimer for important limitations.

3. Accounts and Eligibility

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use.

Each account is associated with one company or individual. You may not share accounts or create accounts on behalf of others without authorization.

4. Payments and Subscriptions

4.1 Free Tier

The free tier includes one AI-only diagnostic case per month. AI-generated reports are available immediately at no cost. Human mechanic review is not included in the free tier.

4.2 One-Time Payments

A one-time payment of $29 USD unlocks human mechanic review and one live call credit for a specific case. This payment is non-refundable once the mechanic review has been completed or the live call has been used.

4.3 Subscription Plans

Monthly and annual subscription plans include a set number of cases, vehicles, and live call credits per billing period. Cases in excess of your plan's included count are billed as overage at the rate published on our pricing page. Subscriptions auto-renew unless cancelled before the renewal date. You may cancel at any time via the billing portal in your account settings.

4.4 Refunds

Payments for completed reports or used live calls are non-refundable. Unused subscription periods are not refunded upon cancellation (access continues until the end of the paid period). If you experience a technical failure that prevents delivery of a purchased service, contact support within 30 days for a review.

4.5 Taxes

Prices listed exclude applicable taxes. Taxes are calculated based on your billing country and added at checkout.

5. AI-Generated Content

Diagnostic reports generated by Pitts use artificial intelligence and, for paid tiers, human mechanic review. These reports are informational only. By using the Service, you acknowledge:

  • AI outputs may contain errors, omissions, or inaccuracies.
  • Reports do not guarantee the diagnosis, repair cost, or outcome of any vehicle service.
  • A physical inspection by a qualified technician is always recommended before performing repairs.
  • Pitts is not liable for any damage, loss, or personal injury arising from reliance on a diagnostic report.

6. User Content and Evidence

You retain ownership of any content you submit (photos, audio recordings, text descriptions, OBD data). By submitting content, you grant Pitts a non-exclusive, worldwide, royalty-free license to use, store, and process that content for the purpose of delivering the Service and improving our AI models (in anonymized/aggregated form).

You must not submit content that is illegal, infringes third-party intellectual property, or contains personal data of others without their consent.

7. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations.
  • Attempt to reverse-engineer, scrape, or otherwise extract data or model outputs at scale.
  • Submit false or misleading information to generate fraudulent reports.
  • Circumvent billing, quotas, or access controls.
  • Use the Service to train competing AI models.
  • Harass, threaten, or abuse Pitts mechanics or staff via the messaging or live call features.

8. Intellectual Property

All trademarks, logos, software, and proprietary content comprising the Pitts platform are owned by Pitts or its licensors. Nothing in these Terms grants you any right to use Pitts branding or intellectual property outside the normal use of the Service.

9. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service, you consent to the data practices described therein.

10. Third-Party Services

The Service integrates with third-party providers including Supabase (database and authentication), Stripe (payment processing), Anthropic (AI models), Daily.co (video calls), Twilio (SMS/WhatsApp), and Resend (email). Your use of these integrations is also subject to their respective terms of service.

11. Limitation of Liability

To the maximum extent permitted by law, Pitts and its affiliates, officers, employees, and contractors shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from or related to your use of the Service, including but not limited to vehicle damage, personal injury, loss of profits, or data loss, even if advised of the possibility of such damages.

Our total liability for any claim arising from these Terms or your use of the Service is limited to the amount you paid us in the 12 months preceding the claim.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

13. Termination

We may suspend or terminate your account at our discretion if you violate these Terms or engage in conduct harmful to other users or to Pitts. You may close your account at any time from the account settings page. Upon termination, your data will be retained according to our Privacy Policy retention schedules.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute shall be resolved by binding arbitration under JAMS rules, or in the courts of Delaware if arbitration is not available.
